Terms of Service

Welcome to Hotly. By downloading or using the Hotly app (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Hotly. By using the Service, you represent and warrant that you are 18 or older.

2. The Service

Hotly lets you create and chat with AI-generated companions. All characters are fictional and generated by artificial intelligence. They are not real people. AI-generated responses and images may be inaccurate, and should not be relied upon as advice (including medical, legal, financial, or psychological advice).

3. Your Account

You are responsible for the activity on your account and for keeping your login credentials secure. You agree to provide accurate information and to keep it up to date.

4. Coins, Subscriptions & Payments

• Certain features require virtual “coins” or a Premium subscription.
• Purchases are processed by Apple through your App Store account. Prices are shown in the app and may vary by region.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID settings.
• Virtual coins have no monetary value, are non-transferable, and are non-refundable except where required by law or Apple’s policies.

5. Acceptable Use

You agree not to:

• Use the Service if you are under 18, or allow minors to access it.
• Use the Service for any unlawful, harmful, harassing, or abusive purpose.
• Attempt to generate content depicting minors or any illegal content.
• Reverse-engineer, disrupt, or attempt to gain unauthorized access to the Service.
• Resell, exploit, or misuse the Service or its content.

We may suspend or terminate accounts that violate these Terms.

6. User Content

You retain ownership of content you submit (such as profile details and messages). You grant us a limited license to use, store, and process that content as needed to operate and improve the Service. You are responsible for the content you provide.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by Hotly and its licensors and is protected by applicable laws. These Terms do not grant you any rights to our trademarks or branding.

8. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Hotly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold Hotly harmless from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which the operator of Hotly is established, without regard to conflict-of-laws principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
